Provides protections to the innocent sellers of products.

Senate Bill 393: Direct Reimbursement For Energency Services Providers

Provides that insurers who approve a claim which includes expenses charged by emergency services organizations would be required to make payment directly to the provider.

House Bill 203: Medical Malpractice Legislation

Limits the recovery of non-economic damages to $250,000 in claims covered by MCARE.

Senate Bill 173: Insurance Bad Faith

Amends section 8371 of Title 42 (the bad faith statute) by substituting the term “trier of fact” for the term “court”, effectively providing for trial by judge or jury of Pennsylvania bad faith actions in conflict with Pennsylvania Supreme Court case law holding that by using the term “court”, Pennsylvania’s legislature intened that bad faith insurance actions be tried by judge.

House Bill 57 And Senate Bill 379: Medical Malpractice

Amends Title 42 by adding section 6145 providing that any benevolent gesture or admission of fault by a health care provider made prior to the commencement of a liabilty action shall be inadmissable as evidence of liability or as evidence of an admission against interest.

Senate Bill 446: Statute Of Repose

Provides that actions to recover damages for death, injury or property damage from a defective product must be commenced within 15 years of the date of delivery of the product to the first purchaser.

House Bill 708: Direct Reimbursement For Ambulance Services

Requires insurers to directly reimburse for ambulance services.

House Bill 23: Amendmants To The Uniform Arbitration Act

Amendments proposed to streamline the practices and procedures of statutory arbitration in Pennsylvania. Among other things, would require arbitrators to disclose conflicts of interest to the parties, require third parties to provide discovery, permot the award of punitive damages, set out how arbitration is commenced and the notice required.
